Terms & Conditions: View-Point Service

The information, stated below, is provided as an addendum to:

PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS OUT THE TERMS UNDER WHICH WEATHERBYS LIMITED OFFERS YOU USE OF ITS VIEW-POINT SERVICE LOCATED AT WWW.POINTTOPOINT.CO.UK/VIEWPOINT ("THE SERVICE"). BY USING THE SERVICE YOU AGREE THAT YOU HAVE READ AND ACCEPT THESE TERMS AND CONDITIONS AND THAT THEY SHALL APPLY TO YOUR USE. IF YOU DO NOT WISH TO BE BOUND BY THEM, PLEASE LEAVE THIS WEB SITE.

This Agreement is made between you and Weatherbys Limited (registered number 3439367) whose registered office is Sanders Road, Wellingborough, Northamptonshire NN8 4BX.

1. View-Point Service Description

1.1 We offer users of this Service access to various archived video footage of races which have been uploaded by our Video Suppliers.

1.2 We may vary, from time to time, the races available under the Service. The fact that video footage of a given race is currently available or available at some future date should not be taken as a guarantee that it will be available on all or any other future dates.

2. Payment

2.1 The Service is made available to you by payment only. Details of the cost of the Service are set out in the Join In section of the Site.

The information in any of the Help Pages or Free-to-View content of the Site is also incorporated into these Terms and Conditions.

3. Accessing the Service

3.1 The Service is currently available via the internet on the pointtopoint.co.uk/viewpoint.

3.2 In order to be able to access the Service, you must have compatible equipment including a computer, high-speed internet access and video software. The following are general minimum system requirements:

> Windows XP or MAC OS X

> Internet Explorer 7 or higher

> Adobe Flash Video Player 9 or higher

> A fast broadband internet connection (512kb or higher)

> A PC/MAC

3.3 You must not do any of the following:

(a) Copy (except as allowed under s.35 (showing in schools) and s.70 (timeshifting for private and domestic use) of the Copyright Designs and Patents Act 1988 ("the Act"), redistribute or relay the Service or any part of it or otherwise deal with the Service or any part of it other than as permitted by the Act. The exceptions in these sections are limited and you must make sure that you are legally entitled to rely on one of them;

(b) Produce, re-produce, supply or otherwise exploit any programme, service or content (whether audio, visual, audio-visual or otherwise) comprised in the Service or any part of it or otherwise use it or any part of it for any commercial purpose whatsoever;

(c) Sell or make any charge for access to the Service or any part thereof;

(d) Show the Service in public to an audience, even if no charge is made;

(e) Otherwise communicate any work or part of the Service to the public by any means or for any purpose;

(f) Without prejudice to any other provision of these Term and Conditions, directly or indirectly using the Service either for yourself or for any other person for any form of commercial gain including, without limitation, using the  Service for the purpose of or in connection with any betting operation or producing so-called "off-tube" commentaries (or similar);

(g) Upload or otherwise make available the Service or any part thereof via any social networking website, including, without limitation, YouTube and similar websites.

3.4 You will fully indemnify us immediately on demand against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Service Terms and Conditions of Use by you (or any other person in your household or anyone else who may access the Service through your terminal using your password or via any peer-to-peer technology or similar) or any other liabilities we or any of our licensors may suffer or incur arising out of your or their unlawful or improper use of or access to the Service.

4. User Agreement

4.1 These terms and conditions are supplemental to the terms of the pointtopoint.co.uk User Agreement , which terms shall apply to the Service. For the purposes of the User Agreement, the Service shall be deemed to form part of the Interactive Services.

4.2 These terms and conditions will take precedence in the event of any conflict between these terms and conditions and the User Agreement in respect of your use of the Service.
